Delmarva Power has an interim increase of about 34 million dollars in effect since July 2026 and is appealing how it was calculated in court; a final decision on the full 75.8 million dollar request is not expected until 2027.

What happens next
The new rate took effect August 28, 2026 and is already on your bill. How rate cases work.
Governor Matt Meyer signed four bills on August 28, 2026 (HB 233, HB 445, HB 310 and SB 326) that create a separate utility rate class for large electricity users such as data centers, require those large loads to bring their own generation, bar them from job creation tax credits, and add new oversight of utility capital spending in Delaware. The legislation is meant to keep the cost of serving large new electric users, including data centers, from being shifted onto residential customers' bills. SB 326 is also the law that caps how large an interim rate increase a utility like Delmarva Power can collect once seven months have passed since it filed a base rate case.
What it means for your bill: This new law is meant to stop the cost of big new electricity users like data centers from landing on ordinary residential bills, rather than raising bills directly.
